Official legal foundation and statutory responsibilities governing Bauchi State Universal Basic Education Board
The Bauchi State Universal Basic Education Board derives its authority from the Bauchi State Compulsory Free Universal Basic Education Law, 2005, which repealed the previous State Primary Education Board Law No. 6 of 1994.
The Board's establishment aligns with the national Universal Basic Education (UBE) Act, which mandates all states to create State Universal Basic Education Boards. The Bauchi SUBEB Law is fully consistent with both the UBE Act and the Constitution of the Federal Republic of Nigeria.
As established by law, the Board exercises the following primary statutory functions:
Provide free, compulsory and universal basic education to every child of school age in Bauchi State
Formulate and implement policy guidelines for Universal Basic Education Programme in the state
Establish and maintain Basic Education database and conduct research on basic education
Manage Primary Schools, Nomadic Education Centers and Junior Secondary Schools across the state
Post, deploy, retire and re-absorb teaching and non-teaching staff including interstate transfers
Undertake capital projects, rehabilitate and maintain dilapidated classrooms and infrastructure
The Board operates under a clearly defined governance framework as stipulated by law:
Serves as Chief Executive and Accounting Officer with full administrative responsibility
Comprising two Permanent Members and three Part-Time Members for policy direction
Includes representatives from key ministries, NUT, PTA, Women Groups and Federal Ministry
The Board's financial operations are governed by specific statutory provisions:
Federal funds allocated through Universal Basic Education Commission
Direct funding from Bauchi State Government budget allocations
Grants from international donor organizations and development agencies
Contributions from Local Government Education Authorities
The law mandates strict financial accountability including annual auditing of accounts, proper disbursement of funds, and maintenance of separate bank accounts for LGEAs. All services in public primary and junior secondary schools must be provided free of charge as stipulated by law.
The Board operates under specific legal provisions and enforcement mechanisms:
Legal requirement for parents/guardians to ensure school-age children attend school
Mandate to monitor and supervise teaching in both public and private primary schools
Legal provision for completely free services in public primary and junior secondary schools
Requirement for annual reporting and auditing of all financial transactions
The Bauchi SUBEB Law establishes clear offences and penalties for non-compliance, ensuring the Board's mandate is legally protected and enforceable. The law also provides for the establishment of Local Government Education Authorities in all 20 LGAs, subject to the Board's control.
